... 目前香港沒有特定法例針對涉及為了性目的而作觀察或視像記錄的窺淫行為，委員會建議，應參照英格蘭《2003年性罪行法令》，新增一條窺淫罪，即是將未經同意下，「為了性的目的而對另一人進行觀察（俗稱偷窺）或視像記錄的行為刑事化」。委員張達明舉例稱，新罪行涵蓋偷拍裙底、在公廁或家中偷窺或偷拍他人冲涼。


有記者問到，假若一名男子在公眾地方望一名女子而有性反應，會否墮入法網，他強調，此罪行在公眾及私人地方均適用，但要證明偷窺者有性目的。

明報版本：... 此罪行在公眾及私人地方均適用，但要證明偷窺者有性目的。此罪須證明被告是為了性滿足，及受害人是在合理期望可有私隱的地方下被偷窺，如在公廁或家中冲涼，被他人偷看或偷拍。


男男版本: ... 受害人要身處「有合理期望冇人睇到自己(裸露)的地方」，並非身處公眾場合，而被告人亦要被證明基於性目的而行事。

經濟日報版本: 法改會建議參照英格蘭訂立《窺淫罪》，以保障個人性自主。犯案者為了性滿足，在未經對方同意下，以觀察、照片、錄影或數碼影像形式，紀錄他人進行私人行為，例如暴露其生殖器官、臂部或胸部、只穿內衣、正在使用廁所或進行性行為等，即屬違法。

Recommendation 3

We recommend introducing a new specific offence of voyeurism.

We recommend that such an offence be along the lines of section 67 of the English Sexual Offences Act 2003.

3.10 Section 67 of the English Act provides for an offence of voyeurism:

"(1) A person commits an offence if—

(a) for the purpose of obtaining sexual gratification, he observes another person doing a private act, and

(b) he knows that the other person does not consent to being observed for his sexual gratification.

(2) A person commits an offence if—

(a) he operates equipment with the intention of enabling another person to observe, for the purpose of obtaining sexual gratification, a third person (B) doing a private act, and

(b) he knows that B does not consent to his operating equipment with that intention.

(3) A person commits an offence if—

(a) he records another person (B) doing a private act,

(b) he does so with the intention that he or a third person will, for the purpose of obtaining sexual gratification, look at an image of B doing the act, and

(c) he knows that B does not consent to his recording the act with that intention.

(4) A person commits an offence if he instals equipment, or constructs or adapts a structure or part of a structure, with the intention of enabling himself or another person to commit an offence under subsection (1)."
